Hukum Acara Perdata di Indonesia masih kokoh berpedoman pada hukum acara peninggalan kolonial. Sumber-sumber utamanya adalah:<\/p>\n

1. HIR (Herziene Indonesisch Reglement), yang awalnya dikenal sebagai Inlandsch Reglement (IR), berlaku untuk golongan Bumiputera dan Timur Asing di Jawa dan Madura. Pembaharuan IR menjadi HIR pada tahun 1941 ternyata tidak membawa perubahan apapun pada HAP perdata di muka pengadilan negeri.<\/p>\n

2. RBg (Reglement Voor de Buitengewesten), berlaku di luar Jawa dan Madura.<\/p>\n

3. Rv (Reglement op de Burgerlijke Rechtsvordering), meskipun semula berlaku khusus untuk golongan Eropa, dalam praktik peradilan saat ini eksistensi ketentuannya tetap dipertahankan dan dipergunakan, misalnya mengenai dwangsom (uang paksa) dan intervensi gugatan perdata.<\/p>\n

4. KUH Perdata (BW), meskipun merupakan kodifikasi Hukum Perdata Materiil, juga memuat beberapa ketentuan HAP.<\/p>\n\n\n\n\n\n\n\n\n
