Sistem hukum nasional Indonesia selama beberapa dekade menghadapi berbagai tantangan struktural, mulai dari dominasi pendekatan positivistik yang cenderung legalistik hingga fragmentasi regulasi yang menghambat efektivitas penegakan hukum. Dalam konteks tersebut, gagasan Ius Integrum Nusantara muncul sebagai suatu paradigma hukum nasional komprehensif yang berupaya mengintegrasikan berbagai sumber normatif hukum secara utuh dan dinamis dalam satu kerangka konseptual yang koheren dan operasional. Secara konseptual, Ius Integrum Nusantara dapat dipahami sebagai suatu sistem pemikiran hukum yang menempatkan hukum bukan semata-mata sebagai kumpulan norma tertulis, melainkan sebagai sistem normatif hidup (living normative system) yang berkembang melalui interaksi antara norma negara, nilai sosial, dan praktik hukum masyarakat. Paradigma ini menolak dikotomi rigid antara hukum negara (state law) dan hukum adat (customary law), serta berupaya membangun sintesis normatif yang memungkinkan keduanya berfungsi secara komplementer dalam mewujudkan keadilan substantif.
